Recycle your cell phones at the Toronto Zoo!

ECO-CELL and the Toronto Zoo collaborates with over 90 other zoos, aquariums and wildlife institutions to educate the public regarding the negative effects of the cell phone industry on wildlife, particularly on gorillas and gorilla habitat in Africa.

Coltan is the metallic ore used to produce the element tantalum and tantalum can be found in almost all cell phones, lap tops, pagers and other electronic devices? Coltan is mined in the Congo rain forest and is most concentrated in the same area where the gorillas live Mining of this ore detroys their habitat.

All funds generated by the project are donated to gorilla conservation programs in Africa. For each cell phone that is recycled, ECO-CELL donates a minimum of $0.45 and a maximum of $15 to the Toronto Zoo's Endangered Species Recovery Fund (ESRF).

Understanding HST

The Toronto Real Estate Board has graciously provided an outline of how the HST will work:

"The provincial government has passed legislation to combine the 8% Provincial Sales Tax with the 5% federal Goods and Services Tax, creating a 13% Harmonized Sales Tax (HST).

The HST is NOT YET IN EFFECT. The HST will come into effect beginning on July 1, 2010; however, note transition rules below.

RULES:
1. HST will not apply on the purchase price of re-sale homes.
2. HST would apply to services such as moving cost, legal fees, home inspection fees, and REALTOR® commissions.
3. HST will apply to the purchase price of newly constructed homes. However, the Province is proposing a rebate so that new homes across all price ranges would receive a 75% rebate of the provincial portion of the single sales tax on the first $400,000. For new homes under $400,000, this would mean, on average, no additional tax amount compared to the current system.

TRANSITIONAL RULES FOR NEW HOUSING:

1. Generally, sales of new homes under written agreements of purchase and sale entered into on or before June 18, 2009 would not be subject to the provincial portion of the single sales tax, even if both ownership and possession are transferred on or after July 1, 2010.
2. The tax would also not apply to sales of new homes under written agreements of purchase and sale entered into after June 18, 2009 where ownership or possession is transferred before July 1, 2010.

TRANSITIONAL RULES:

1. Where services straddle the HST implementation date of July 1, 2010, the tax charged for the service may have to be split between the pre-July 2010 and post-June 2010 periods. However, the HST will generally not apply to a service if all or substantially all (90% or more) of the service is performed before July 2010.

Four key timelines are important (see below). All are based on the earlier of the time the consideration is either due (In general, an amount is due on the date of the invoice or the day required to be paid pursuant to a written agreement), or is paid without having become due. If consideration is due or paid,
Before October 15, 2009, HST will generally not apply (however, see above transition rules for new housing).
From October 15, 2009 to April 30, 2010, certain business that are not entitled to recover all of their GST/HST paid as input tax credit may be required to self-assess the provincial component of the HST with respect to goods or services supplied after June 30, 2010.

From May 1, 2010 to June 30, 2010, HST will generally apply for services supplied after June 30, 2010.
After June 30, 2010, HST will generally apply. An exception to this rule would be where ownership of the property is transferred before July 2010 or the invoice relates to services provided before July 2010.
With regard to the lease or license of goods, including non-residential real property, HST will generally apply to lease intervals or payment periods on or after July 1, 2010 and the general rules noted above will apply. However, where a lease interval begins before July 2010 and ends before July 31, 2010, it is not subject to HST.

With regard to the sale of non-residential property, HST is due where both possession and ownership of non-residential property occurs on or after July 1, 2010."

HST & how it will impact you!

The Ontario Government recently enacted legislation which will implement the much-dreaded HST Tax. This new tax will take effect on July 1, 2010. The HST tax will effectively combine the Provincial Sales Tax of 8% percent with the Federal GST Tax of 5% percent, to create a new "harmonized" total tax of 13% percent. This new tax will be applicable to many real estate services which hitherto only had one or the other tax applied. The HST will result in a 13% tax on new home construction, but my post today will concern those ancillary costs pertaining to the buying and selling of resale residential real estate properties in Ontario...

First, the good news....there is no HST tax payable on the sale of a resale home (residential). So the single largest dollar amount exchanged is not taxable under HST.

However, under the harmonized sales tax (HST), home buyers and sellers will have to pay extra tax on a range of services associated with the real estate transaction: services such as legal fees, moving costs, real estate commissions and home inspection fees. Currently, consumers only pay the 5% Goods and Services Tax (GST) on these services.

In a nutshell, after July 1, 2010, if you are a seller, there will be a 13% percent tax payable on the real estate commission you pay - currently there is only the 5% percent GST payable on this fee. Your lawyer's fee will also be subject to the 13% percent HST, as will the cost of a Condominium Status Certificate.

If you are a buyer, any Home Inspection you pay for will be subject to the 13% percent HST. And so will the cost of movers hired. In addition, the cost of the CMHC premium for "high-ratio" mortgages has traditionally been taxable for PST - this amount will now be taxable for the full 13% percent HST.

So one can see that, with the introduction of the HST, whether you are buying or selling a Resale Home in Ontario, costs will be going up.

A press release from the Ontario Real Estate Association earlier this year summarized some of these changes which will take place - the example that they used was for a resale house priced at $360,000, and it was determined that the HST would add over two thousand dollars in new taxes to closing costs. Please note, these taxes are in addition to the Land Transfer Taxes which exist for both the Province and the City of Toronto. OREA calculated that, in total, the HST would add $313 million annually in new taxes to resale home transactions.

The HST Ontario Tax will add to the cost of buying and selling a resale home. Many market watchers are predicting a flurry of activity leading up to the July 1, 2010 implementation date, as buyers and sellers both try to avoid paying the tax.

Good news about the real estate market!!

Finally some good news about the Real Estate market! I heard a little tid bit on 680 News yesterday about how the "doom and gloom" of the market is on its way out and home values are on the rise. They stated that for 2009: "In Toronto, the average price of a standard condo rose 2.9 per cent to $309,316, detached bungalows rose 9.9 per cent to $446,214 and standard detached homes increased 3.5 per cent to $564,175".

And of course, interest rates are still low which increases activity and right now there is almost no inventory for these buyers to look at. This being the case, it is rare not to be in a multiple offer situation.

Contractor ratings online!

Have you seen this? I read an article in the Toronto Star this past Saturday by Ellen Roseman. Apparently there is a website dedicated to reviews of over 40,000 contractors in the city called Homestars. On this site, homeowners can post their experiences with their renovations/contractors (good or bad). This gives you the opportunity to find reputable contractors (or not) and read their client references/comments. Visit HomeStars.com. I believe it is free to register but there is a fee if you want to post a comment. Many companies encourage their clients to post a review on the HomeStars website and may even offer a discount if you do. Along with a detailed blog you will find events and a savings page. Beware of the savings page though because companies can post coupons and not have any reviews about themselves so no one is really sure how good they are. We always recommend getting at least 3 quotes before deciding on any one contractor. You will find a wealth of information on this site.
